Hot Yoga Hilo LLC (HYH) – Terms & Conditions

1. Acceptance of Terms

By participating in classes at Hot Yoga Hilo LLC ("HYH") or accessing any of the Virtual Hot Yoga Hilo ("Virtual HYH") platforms, including but not limited to:

You agree to be bound by these Terms & Conditions and acknowledge that: (a) You have read, understood, and accepted these Terms; (b) You will comply with all applicable laws and regulations in relation to your use of our services; (c) You are at least eighteen (18) years old and have the legal capacity to enter into a contract in your jurisdiction.

2. Privacy Policy & SMS Compliance

2.1 Data Privacy & Communication Preferences

Hot Yoga Hilo LLC values your privacy and adheres to all applicable regulations regarding data security and consumer privacy.

  • No Improper Consent: We do not improperly claim consumer consent for sharing data with third parties for marketing purposes.

  • No Data Sharing: We do not share mobile device information for marketing purposes without explicit consent from the user.

  • Consumer Rights & Contact Information: You have the right to opt out of receiving SMS messages at any time. To opt out, reply 'STOP' to any message you receive from us or contact us at info@hotyogahilo.com or call (808) 215-9220.

  • No Data Transfers: We will not transfer your personal data to external organizations without your explicit consent, except as required by law. We do not share mobile device information for marketing purposes without explicit consent.

  • Help & Opt-Out Instructions: You have the right to opt out of receiving SMS messages at any time by replying 'STOP' to any message you receive from us. Text 'HELP' for assistance. To opt out, reply with STOP, CANCEL, QUIT, END, UNSUBSCRIBE, or STOPALL.

2.2 SMS & Email Communications

Hot Yoga Hilo LLC uses WellnessLiving software to facilitate automated notifications and marketing communications.

  • Opting Into Communications: Members can opt in to receive SMS or email notifications through the Notifications tab in our Client Web App, where they can adjust their preferences for:

    • Class reminders

    • Service updates

    • Account activity alerts

    • Marketing campaigns and business updates

  • New Client Opt-In Process: The opt-in process is entirely paper-based and does not involve a webform. For new leads added manually or through our Lead Capture Widget, we send a Notification Opt-In Request containing a "CONFIRM SUBSCRIPTION" button, directing users to customize their communication preferences.

  • Managing & Opting Out: You may modify your notification preferences at any time via the Notifications tab in the Client Web App. You may opt out of SMS notifications by replying 'STOP' and from marketing emails by clicking "Unsubscribe" in the email footer.

  • Message Disclosure: By opting in, you agree to receive messages from Hot Yoga Hilo LLC. Message frequency varies, and message & data rates may apply.

  • Message Frequency Estimate: You may receive messages up to twice a week.

  • Opt-In & Opt-Out Keywords: To opt-in, reply with START, YES, or UNSTOP. To opt-out, reply with STOP, CANCEL, QUIT, END, UNSUBSCRIBE, or STOPALL. For help, reply with HELP. 3. Participation in Online & In-Person Yoga Classes

3.1 Assumption of Risk

Yoga and wellness programs involve physical activity that may cause injury. By participating, you assume full responsibility for any associated risks.

3.2 Medical Clearance

You confirm that you have consulted a physician before participating if you have any medical conditions, injuries, or pregnancy.

3.3 Safety & Modifications

You agree to listen to your body, rest as needed, and avoid postures that cause discomfort.

4. Liability Waiver & Release

By participating, you waive any claims against Hot Yoga Hilo LLC, its owners, instructors, staff, or affiliates for any injuries or damages sustained.

5. Media Release

By attending classes, events, or activities, you grant Hot Yoga Hilo LLC permission to photograph or record your likeness for promotional purposes. If you do not wish to be recorded or photographed, notify the instructor before class begins.

6. Virtual Class Participation & Privacy

Live-streamed classes may display video feeds of other participants. Turn off your video if you do not wish to be seen.

7. Agreement to Terms

By booking any class through www.hotyogahilo.com or the Hot Yoga Hilo App, you acknowledge and agree to these Terms & Conditions.
